Terms of Service for Live Livestock Deliveries

TERMS OF SERVICE FOR LIVE LIVESTOCK DELIVERIES

1. Acceptance of Terms

By placing an order for live livestock (including but not limited to day-old chicks, juveniles, and point-of-lay birds) on KALEOM LTD, you explicitly agree to the specialized terms, conditions, and logistical liabilities outlined below. Because live animals are highly sensitive perishable cargo, these terms supersede our standard dry-goods shipping policies.

2. Sourcing and Fulfillment Model

KALEOM LTD operates as an authorized agricultural procurement  platform. We partner directly with a vetted network of premium hatcheries, certified seed scientists, and institutional livestock manufacturers to fulfill your orders. While we guarantee that all items are healthy, fully vaccinated, and quality-vetted at the point of dispatch, KALEOM LTD utilizes a distributed fulfillment model where items are shipped directly from our specialized production partners to optimize transit speed and ensure freshness.

3. Order Processing and Timing

• Hatchery Schedules: Live livestock orders are strictly tied to commercial hatchery setting and hatching schedules. Delivery dates provided at checkout are estimates only.
• Delays: If a hatchery experiences an unexpected drop in hatch rates, temperature fluctuations, or technical issues, your delivery may be rescheduled for the next available hatch date. We will notify you immediately of any schedule changes.
• Cancellations: Livestock orders are locked into hatchery production cycles. Cancellations or modifications are not permitted within 72 hours of the scheduled hatch/dispatch date.

4. Shipping and Terminal Pickup Policy

• No Home Delivery: To guarantee maximum survival rates, live livestock cannot be delivered to residential home addresses via standard courier.
• Terminal Pickup: All live orders are shipped via specialized, ventilated transport networks to a designated regional transit hub or vehicle terminal (e.g., motor parks or specialized depot hubs).
• Buyer Responsibility: It is the buyer’s sole responsibility to monitor transit notifications and arrive at the designated pickup terminal at least 30 minutes before the arrival of the vehicle, or immediately upon notification from the driver/agent.
• Abandonment: If a buyer fails to pick up their livestock within [e.g., 2 hours] of arrival at the terminal, the order is considered abandoned. Abandoned orders are non-refundable, and any resulting mortality is the sole financial loss of the buyer.

5. Mortality (DOA – Dead on Arrival) and Claims Policy

We understand that transit stress can occasionally cause losses. To protect both parties, we enforce a strict, time-bound claims process:
• The Hatchery Cushion: Hatcheries typically include an extra 2% to 5% bonus birds in every box to account for normal transit stress. Dead on Arrival (DOA) claims will only apply if the total mortality exceeds this bonus percentage.
• Verification Window: The buyer must inspect the livestock at the pickup terminal in the presence of the delivery agent or transit driver.
• Filing a Claim: If there is excess mortality, the buyer must take clear, high-resolution photographs and videos showing:
1. The dead birds counted out outside the transport box.
2. The remaining live, healthy birds.
3. The delivery vehicle or terminal background.
• Submission Deadline: All photographic evidence and official complaints must be submitted to our customer support channel via [Your Support Email/WhatsApp Number] within two (2) hours of terminal pickup.
• Exclusions: Claims submitted after the livestock has left the pickup terminal, or after the 2-hour window has expired, will be strictly rejected. We do not cover post-delivery mortality caused by poor brooding infrastructure, improper temperature control, or handling errors at the buyer’s farm.

6. Limitation of Liability

To the maximum extent permitted by law, KALEOM LTD shall not be held liable for any indirect, incidental, or consequential losses incurred by the buyer. This includes, but is not limited to: farm business losses, feed expenses, labor costs, or veterinary expenses resulting from transit delays, stress-induced flock illnesses, or delivery shortages. Our total liability for any validated claim is strictly capped at the purchase price of the specific affected livestock.
